About Martin

A Partner in TransAsia’s employment law practice, Martin is a graduate of the East China University of Politics and Law (B.A. in Law). He has 9 years of experience in advising clients on employment law matters in China. Before joining TransAsia, Martin was with the legal consulting department at China International Intellectech (Shanghai) Corporation (CIIC), which is the largest labor dispatching agency in Mainland China.

Martin specializes in advising clients on the following matters: drafting employment documentation (e.g., employment contracts, employee handbooks, and non-compete agreements), social security, wages and working hours, labor dispatching, retrenchment, employee termination, expatriate employment, and dispute resolution (mediation, arbitration and litigation). In addition, he frequently provides internal legal training on daily employment issues and employment contract management to the senior managerial and HR personnel of our clients.

Prior to his time with CIIC, Martin spent 3 years doing IPR protection throughout Mainland China with an IPR agency. In 2009, he became qualified as an “Enterprise Legal Adviser”, which qualification was jointly issued by the PRC Ministry of Human Resources & Social Security, the State-owned Assets Supervision & Administration Commission, and the Ministry of Justice.

Recent Projects

  • Advised on personnel transfer and the integration of HR systems due to a merger of 2 companies involving over 400 employees in China
  • Assisted with the collective termination of employees due to the early dissolution of the company
  • Advised on re-designing a client’s internal HR management system and procedures for compliance with PRC law
  • Assisted in negotiations with employees for the termination of their employment contracts due to closure of a business unit
  • Provided internal legal training on daily HR management and employee termination to the senior managers and HR staff of a client
  • Advised and represented a client in a series of arbitration and litigation cases involving the ex-GM and his followers (ex-deputy GM and other senior management personnel), where the claims amounted to RMB 12m
  • Assisted in the investigation and termination of a client’s GM for embezzlement and represented the client in the ensuing labor dispute arbitration and litigation proceedings
  • Assisted a client in interviewing and investigating employees for a conflict of interest, and with the subsequent termination of employment
